Terms and Conditions (Freelancers)

Webdiary.tv is a booking service. It is a subscription service for freelancers, with varying levels of monthly fee. Freelancers (depending on service level) can make themselves available via the service, be viewed by companies and be booked by them, but only on the following understandings.

You must provide us with an accurate and working email address that is regularly checked. This will be the address that all diary actions will be sent to and this provides you with an opportunity to keep accurate records of all such diary actions.

There are currently three levels of membership with varying subscription rates and features. The 'diary only' level is an introductory trial membership offered at no charge for a maximum of 3 months. It is designed to introduce you to the concept of making diary entries, but offers no client interaction.

The 'basic' level is available to all registered freelancers for a monthly subscription. It gives you the chance to be associated with three clients on the system, and to receive email notification of any bookings they make.

The 'full' level, at a higher monthly subscription rate, is only available to those freelancers who have been recommended by three or more webdiary clients and allows you to be searched and preferred by all of our clients. It also allows you to enable text (short message service/texting) features (extra costs may apply).

If you wish to use the text features of the site then you must provide us with an accurate and working mobile telephone number. Please be aware that there may be additional charges levied by telephone operators for receiving text messages, particularly if you are roaming overseas. It is your responsibility to make yourself aware of those charges before turning on the text feature.

You must keep your password secure and change it regularly. We recommend that you use numeric characters within your password. Never let anyone else log in with your username and password (as they would then be representing you to other users of webdiary.tv).

The normal booking terms and conditions apply with respect to being employed by companies, including (but not limited to) rates of pay (overtime, holiday and sickness entitlements), scheduling issues (including any legal responsibilities regarding working hours), taxation, national insurance, VAT, transportation, expense and insurance issues.

Whilst we will always try to ensure that our companies are responsible and genuine we cannot vouch for them. You are urged to check the information they provide about themselves online and contact them as necessary to ensure that you are happy to work for them. Webdiary.tv gives no assurances on this front.

When you are booked as a freelancer via webdiary.tv it is understood that you have agreed terms and conditions with that company. This will include rates of pay (which may be per hour/day/week or other), rates and terms of overtime (which may be a buyout, 1.5T after midnight, 2T after 8 hours or other) and any other conditions of employment. Webdiary.tv does not involve itself in these negotiations.

Pencil booking means that the company has first call on that freelancer, if anyone else tries to book you the first pencilling company will be given option of confirming or cancelling. You may also use the website to encourage a company to confirm or cancel a pencil booking. If you find any companies abusing the pencil booking system then you can choose to 'avoid' them in your preferences or inform webdiary.tv.

Confirmed booking means that the company will definitely use the freelancer on that booking. This results in the freelancer appearing 'unavailable' to other clients and may cause other work to be rejected. This is highly likely to result in a charge if the company cancels. The level of this charge will be in accordance with your agreement with the company.

We will not sell or pass on to any third party your details without your prior consent. By using the system you are agreeing to the contact details you provide being available to other users of the system. If you suspect that any other user is abusing the access to these details then please inform us.

We reserve the right to cancel. downgrade or suspend any user at any time, particularly for abuse of the system or any behaviour that degrades the perception of webdiary.tv. This would include (but is not limited to) failure to maintain your diary properly and failure to fulfil bookings made through the system.

We reserve the right to limit or suspend our service at any time. We also reserve the right to introduce or increase charges for elements of the service as necessary. At least one months notice will be given of any change to the charging system.

The webdiary.tv system is protected by copyright and is confidential. By using the system you undertake not to endanger our copyright or to expose the workings of the system to anyone who wishes to do the same.

Any recommendations, criticism or other general feedback will become the property of webdiary.tv. This will include copyright and intellectual property rights.

Webdiary.tv retains the right, at its discretion, to issue publicity including your name and biographical detail unless you inform us in writing otherwise.
